1. TOUR OPERATOR
Diamond Guettaway Group LLC (“Tour Operator”) has arranged the Pesach vacation packages described in this contract and the confirmation.
Guest lodging is at the Park Hyatt Riviera Maya. All programming, meals, and events take place at the Waldorf Astoria Riviera Maya, not at the Park Hyatt Riviera Maya.
2. RESERVATION
Reservations are subject to availability and are conditioned upon receipt by us of the deposit stated above at the time of booking and execution of this Contract. The balance is to be paid as set out under Payment Instructions.
Prior to attendance at the program, a major credit card authorization form must be filled out and signed. This is in accordance with hotel policies and for any incidentals which you or anyone in your party may incur during the program.
3. PAYMENT & CANCELLATION SCHEDULE
1. Initial Deposit & Rate Confirmation
A 50% deposit of the total reservation to confirm your reservation.
Refund Policy: This initial deposit is fully refundable if a cancellation request is received in writing by October 05, 2026.
2. Final Balance
The remaining 50% of the total reservation is due by January 04, 2027.
4. ADDITIONAL INFORMATION
All payments made after October 5, 2026, are non-refundable.
Cancellations must be made directly with us and must be received in writing at our office before they are acknowledged. This cancellation policy is strictly adhered to and reflects the risks and costs associated with the program.
Reservations are non-transferable and group cancellation policies may differ. We strongly recommend that you buy travel insurance.
Tour Operator reserves the right to withdraw the program announced and/or make any alterations necessary for the proper operation of the program. This can be done at the discretion of the Tour Operator, for any reason, without penalty.
If the Tour Operator cancels a tour, the company has no responsibility beyond the refund of all monies paid to the company by the tour participant for the land package.
Airline tickets are not included in the package and are subject to airline regulations.
No person, other than an authorized representative of the tour by a document in writing, is authorized to vary, add or waive any term or condition.
5. PASSPORTS AND TRAVEL DOCUMENTS
Everyone traveling to Mexico (including newborns, infants and children) must have a valid passport. All guests must present passports at the time of check-in at the hotel.
6. CONDITIONS AND RESPONSIBILITY
Tour Operator is responsible for arranging the Pesach program offered. Every effort will be made to accommodate room requests. However, these requests cannot always be guaranteed with 100 percent certainty due to variables beyond our control and the hotel’s control.
Participant fully understands and voluntarily assumes all risks inherent in international travel.
Tour Operator, in arranging any accommodations or in rendering services in connection therewith, does so as agent for the individual desiring such travel accommodations upon the express condition and your agreement and understanding that neither the Tour Operator nor the hotel shall be liable for, AND YOU HEREBY RELEASE US from, any injury, loss, damage, accident, illness, delay, irregularity or expense arising from the use of any travel or lodging facilities, accommodations or services provided in connection with such individual’s travel plan or with the services provided by Tour Operator; and from any injury, loss, damage, accident, illness, delay, irregularity or expense arising from strikes, war, weather, quarantines, sickness, pandemic, government restrictions or regulations, from any act of omission by Tour Operator, individual, or corporation furnishing transportation, sightseeing, hotel accommodations or any other services in connection therewith, for any additional cost or expense due to disruption or change of advertised schedules, rates or services or for any cause.
You agree to hold harmless and indemnify Tour Operator from any and all claims, controversies or disputes arising out of or relating to this agreement that are asserted by members of your party.
7. FLIGHT DISCLAIMER & COMPLETE RELEASE
Participant is completely free to purchase air transportation to and from the Pesach program from any airline, travel agent, or source of their choosing, and is under no obligation to use Tour Operator’s group flights, block seats, or charter flight.
Participant acknowledges that all air transportation arranged by Tour Operator upon your request – whether commercial group flights, privately booked tickets, or the post-Pesach charter flight – is arranged solely as an accommodation to Participant and is provided by air carriers or charter operators that are independent contractors and not agents, servants, or employees of Tour Operator.
Tour Operator assumes no responsibility or liability whatsoever for any aspect of air transportation including, without limitation, availability, scheduling, delays, cancellations, overbooking, baggage loss/delay/damage, in-flight service, safety, security, medical emergencies, passenger conduct, or any injury, death, damage, loss, expense, or inconvenience arising from or related to air travel, regardless of cause or fault and even if due in part to the negligence of the airline or charter operator.
Participant, for themselves and all members of their party (including minors), hereby fully releases and forever discharges Tour Operator, its owners, officers, employees, agents, and affiliates from any and all claims, liability, demands, or damages of any kind arising from or connected in any way with air transportation, whether the flight was purchased through Tour Operator or independently.
Participant is solely responsible for obtaining adequate travel insurance covering flight-related risks.
8. RESORT ACCESS, DINING & PROGRAM ARRANGEMENTS
The Passover program is hosted across the Park Hyatt Riviera Maya and Waldorf Astoria Riviera Maya, offering a coordinated experience between the two properties.
Each guest's reservation provides access to the accommodations, facilities, amenities, and designated dining venues associated with their respective hotel, as determined by the Tour Operator and participating resorts.
Certain meals, dining experiences, entertainment, religious services, and other program activities may be hosted jointly or separately at either property, regardless of the guest's hotel of accommodation.
A reservation at either property does not automatically entitle guests to unrestricted access to the facilities, amenities, or dining venues of the other property.
Access to shared experiences and designated venues will be provided in accordance with the program arrangements established by the Tour Operator.
Guests acknowledge that dining and program locations may vary throughout their stay and that participation in certain activities or meals may require attendance at the alternate resort. Such arrangements form part of the overall Passover program.
9. VIDEOTAPE/PHOTOGRAPHIC RELEASE
By virtue of your presence, you understand and give permission for you to be photographed or videotaped and you give permission to use photographs or videography without limitation.
You explicitly release Tour Operator from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of your picture, voice or likeness.
10. DISPUTE RESOLUTION
Any dispute arising between Tour Operator and participant and/or members of participant’s party or relating in any way to the travel envisaged by this document or the confirmation shall be resolved exclusively by arbitration, on an individual basis, before the Beth Din of America (affiliated with the Rabbinical Council of America).
The parties consent to the exclusive jurisdiction of the courts of the State of New York for the purpose of enforcing any determination of the Beth Din, and enforcing this arbitration clause.
Any arbitration with respect to a dispute relating to the travel envisaged by this document or the confirmation shall commence within two months of the last day of the event, or such dispute shall be deemed waived.
